Registration of real estate fund companies in the register of privileges
FAQs

This service allows real estate fund companies to register in the Privilege Register, which is an electronic document established in the DLD to register real estate investment funds, and to enable them to benefit from the benefits stipulated in the provisions of Decree No. 22 of 2022.

Nothing

1). A commercial license issued by the competent authorities in accordance with Decree No. 22 of 2022 (provided that the names of the founders mentioned in the license match the owners of real estate assets at the time of incorporation)
2). Real estate assets whose market value is not less than 180 million dirhams. (Based on an appraisal certificate issued by the DLD not less than six months from the date of issuance for each property or appraisal companies approved by the Real Estate Regulatory Agency)
3). Copies of the identity cards or passports of the founders of the fund.. (valid documents)
4). A copy of an approved authorization for the person authorized to follow up the registration procedure or any other transactions related to the fund at the DLD.. (an official power of attorney or an officially approved board of directors decision)
5) A fund manager approved by the DFSA.
6) A contract of incorporation for the fund showing the number of founders and the value of each share of the shareholders.

1) The names of the founders mentioned in the license must be identical to the owners of the real estate assets at the time of incorporation
2) The real estate assets must be evaluated based on a valuation certificate issued by the DLD that is not less than six months from the date of issuance for each property or evaluation companies accredited by the Real Estate Regulatory Agency.
3) That the authorization of the person authorized to continue the registration is an official power of attorney or an officially approved decision of the Board of Directors
4) The Fund's Memorandum of Association must list the founders and the value of each shareholder's share.
5) The registration of the real estate investment fund shall be removed from the register, in any of the following cases:
A. His loss of any of the conditions of incorporation.
B. Declaring his bankruptcy pursuant to a final court ruling.
D. Solve it and liquidate its assets.
E. Cancellation and liquidation of its assets.
F- Restricting his activity by virtue of a final court ruling
G- Deletion of the Real Estate Investment Fund from the Register shall result in the cessation of all benefits granted to it pursuant to this Decree, provided that all benefits enjoyed by the Real Estate Investment Fund prior to the date of its deletion from the Register are considered correct and producing their effects.

1) 10,000 dirhams registration fees in the Real Estate Funds Privilege Register.
2) For real estate that is added at the time of incorporation, flat fees amounting 50 ,000 dirhams for each real estate project.
3) 2% is collected when the fund purchases any real estate in its name during the period of its activity.
4) Collecting 4% of the market value of the property when the real estate investment fund sells any of the properties it owns within its real estate portfolio.
5) Collecting 2% of the market value of the property when registering a usufruct right or a long-term lease right.
6) Collection of 4% of the market value of the property when the real estate investment fund waives the right of usufruct or the right of long-term lease.

Via the service centre:-
The first step: the customer visits one of the service centers - Real Estate Services Registration Trustees Centers
Second Step: The customer submits the documents and requirements for registration
Step Three: All transaction data is entered into the system by the employee and is checked and approved
Step 4: The customer pays the fees and obtains the payment receipt electronically.
Step Five: The customer will receive the real estate ownership certificate electronically via e-mail
Step Six: The customer will receive a document with the registration number in the real estate concession register
